We intend to deal with Intellectual Property Infringement Claims on a very strict note. Also, we do not endorse display of such materials (as considered to be an alleged infringement) on our website.

Intellectual Property Rights Protection Policy

1. Listing of Similar Products

Any product/service on our website which seems to have similarities with respect to product image, name, signature, branding or other undeniable detail of any person are prohibited unless approved by the particular person whose information is being used/showcased.

2. Selling of Forged/Bogus Products

2.1 Any product that is a non-licensed replica or a counterfeit, such as counterfeit designer watches, shoes, bags, and garments is strictly prohibited to be advertised on our site, Emart Business.

2.2 Products which include names or logo of a company can only be sold by the original manufacturer/producer. A product that was not originally manufactured/produced and is not endorsed/promoted by the company itself is prohibited on our site.

2.3 A branded product may be sold on our website if the seller has a valid license; a certificate of authorization from the original brand owner is a prerequisite for the same.

2.4 Any products which are not authorized, imitated and forged, will not be allowed to be listed under any product category of Emart Business. Such product posting, if found any, may be removed anytime by us and such users will be informed through a warning message. But, if the same thing is repeated, the user may face prompt suspension of the account.

3. Software

3.1 Any academic software, which is sold at a discounted price to students, teachers and employees of accredited learning institutions, must be authorized. Such license/permit issued by the authorized education reseller or the institution must be provided to Emart Business.

3.2OEM Software, which are sold at the time of purchase of a new computer, are only allowed to be listed with sale of computer hardware.

4. Unauthorized Copies (Pirated, Duplicated) of protected/licensed work such as software programs; movies; video games; photographs etc. is prohibited to be listed or sold on Emart Business.
5. If repeated violations of our IPR policy is observed, then it may result in even removal of such product listing, restriction on product posting, suspension of account etc. depending upon severity of violation.

Emart Business preserves the full right to take strict enforcement action against any conspicuous situation, especially if any intellectual property rights holder himself has raised a concern over it.

If any IPR Owner complaints about Alleged Infringement (Trademark; Patent; Copyright etc.) to Emart Business, concerned is liable to provide all the necessary documentation and other relevant information like r egistration certificate, original creation copies, initial publication etc. as required by us.

NOTE: THE INTELLECTUAL PROPERTY RIGHTS WILL BE UPDATED ON A CONTINUOUS BASIS AND SHOULD NOT BE CONSIDERED EXHAUSTIVE AT ANY POINT OF TIME.
